These Terms of Use govern access to and use of Vistus, including the public website, dashboard, audit features, uploads, analyses, payments, credits, integrations, and related communications.
By accessing the platform, creating an account, uploading documents, purchasing credits, opening analysis levels, or using any feature, you confirm that you have read, understood, and accepted these Terms. If you do not agree, do not use the platform.
These Terms use strong language to protect the platform, always to the fullest extent permitted by applicable law. Any invalid provision should be interpreted or adjusted to preserve the remainder of the document.
Acceptance of the Terms
Using the platform constitutes full acceptance of these Terms, the Privacy Policy, commercial rules shown at the time of purchase, and operational instructions available in the interface.
You represent that you have legal capacity to contract for and use the platform in your own name or on behalf of the person, company, client, or organization you represent. Anyone using the platform for another party represents that they have sufficient authorization to do so.
Account, credentials, and eligibility
You must provide accurate, complete, and current information. Credentials are personal and non-transferable, except through formal team or collaboration features provided by the platform.
Vistus may refuse, suspend, limit, or terminate accounts in cases of suspected fraud, abuse, breach of these Terms, security risk, payment misuse, infringement of third-party rights, or legal requirement.
Not legal, financial, or official advice
Vistus provides technical auditing, information organization, automated analysis, operational support, and suggestions based on user-submitted documents. The platform does not provide legal advice, legal representation, accounting services, financial consulting, official determinations, immigration guarantees, or government decisions.
No score, alert, comparison, suggestion, rewrite, message, report, or recommendation should be interpreted as a legal opinion, promise of approval, instruction to omit information, authorization to file, or substitute for independent professional review.
Permitted use
You may use the platform to organize, review, and audit your own documents or third-party documents when you have legitimate authorization to do so.
All use must comply with applicable law, privacy rights, intellectual property, professional confidentiality, government-agency rules, third-party contracts, and reasonable security standards.
Prohibited uses
You may not use the platform in an unlawful, fraudulent, deceptive, abusive, discriminatory, offensive, invasive, excessively automated, security-harming manner or in a way contrary to the service's legitimate purpose.
Vistus may block content, limit access, preserve records, notify providers or competent authorities, and take technical measures when it identifies risk, abuse, or a breach of these Terms.
- Upload false, altered, unlawfully obtained, or unauthorized documents.
- Use results to defraud a government authority, third party, financial institution, or selection process.
- Attempt to bypass limits, payments, security controls, authentication, or monitoring.
- Insert malicious code, malicious prompts, exfiltration instructions, offensive content, or third-party data without a legitimate basis.
- Resell, copy, train a model on, reverse-engineer, or commercially exploit the platform without express authorization.
User-submitted content
You retain ownership of documents, text, evidence, images, registration information, and other content you submit. By submitting content, you grant Vistus a limited, non-exclusive license necessary to host, process, analyze, protect, display, and make results available within the platform.
You represent that you have all rights, authorizations, and legal bases required to submit the content, including where it contains personal, sensitive, or financial data or data about family members, clients, employers, employees, partners, or other third parties.
Sensitive documents and data
The platform may receive identity documents, passports, résumés, letters, supporting records, financial data, professional information, academic evidence, family data, immigration records, and other sensitive materials.
Submitting this data is your decision. Vistus is not responsible for excessive, unnecessary, inaccurate, unauthorized, or purpose-incompatible data, or for data submitted in violation of law, contract, confidentiality, or professional duty.
Payments, credits, and access levels
The platform may charge for credits, packages, plans, access levels, one-time analyses, or additional features. Prices, terms, validity, availability, taxes, coupons, and promotional rules may vary and will be shown in the interface or commercial communications.
Payments may be processed by third parties. Vistus need not store full card numbers and may receive only confirmations, identifiers, statuses, receipts, and transaction metadata. Improper disputes, fraud, chargebacks, or promotional abuse may result in suspension, charges, benefit reversals, and record preservation.
The operator's tax and registration information appears on receipts and invoices issued by the payment and billing provider.
Cancellation, refunds, and withdrawal rights
As a general rule, payments are non-refundable. Unused, expired, or remaining credits do not create a right to a refund, and requesting account closure does not entitle you to a refund of credits or amounts already paid.
Any refund granted is evaluated case by case and will not be due where there has been a breach of these Terms or the Privacy Policy, misuse, fraud, promotional abuse, an improper chargeback, or noncompliance with applicable law.
Where consumer-protection law applies, any statutory withdrawal right for distance purchases will be honored within the legally required period—generally seven days from purchase under applicable Brazilian law—and only for the portion of the service not yet performed. Analyses, access levels, and credits already used or processed are considered services actually performed and are not refundable.
Intellectual property
The platform, brand, layout, workflows, software, models, prompts, criteria, reports, interfaces, databases, documentation, and other Vistus elements belong to the operator or its licensors.
You acquire no ownership interest in the platform. You may not copy, modify, distribute, sell, sublicense, exploit, extract data in bulk, remove proprietary notices, or create a competing service based on protected Vistus elements.
Third-party services
Vistus may depend on providers of infrastructure, authentication, storage, payments, analytics, communications, artificial intelligence, monitoring, support, and security. These third parties may have their own terms and policies.
Vistus does not fully control third-party services and is not responsible for failures, outages, changes, prices, decisions, sanctions, interruptions, breaches, or provider conduct beyond the platform's reasonable control.
Availability and changes
The platform is provided as available. Maintenance, errors, limitations, queues, instability, temporary loss of access, feature changes, price changes, or partial or total unavailability may occur.
Vistus may modify, suspend, or discontinue features for technical, commercial, regulatory, security, or strategic reasons without creating an automatic right to compensation, except where required by applicable law.
Government authorities
Vistus may comply with orders, requests, subpoenas, demands, and judicial, administrative, or regulatory measures it considers valid or necessary, and may preserve and provide records where required by applicable law or to defend rights.
Nothing in these Terms requires Vistus to resist, challenge, delay, conceal, indemnify, or defend a user against a government authority, investigation, inspection, proceeding, sanction, charge, block, removal, inadmissibility finding, denial, fine, or other government action.
Warranty disclaimers
To the fullest extent permitted by applicable law, the platform is provided without warranties of fitness for a particular purpose, immigration approval, financial outcome, acceptance by an authority, error-free operation, uninterrupted operation, compatibility, permanent availability, or absolute accuracy.
Automated results may contain errors, bias, omissions, incomplete interpretations, or contextual limitations. You should critically review every output and seek professional guidance before making significant decisions.
Limitation of liability
To the fullest extent permitted by applicable law, Vistus will not be liable for indirect losses, lost profits, lost opportunities, reputational harm, immigration decisions, fines, fees, denials, delays, investigations, government actions, misuse, user content, third-party conduct, or failures beyond its reasonable control.
Where liability cannot be excluded, it will be limited to the amount actually paid by the user to Vistus for the feature directly related to the event giving rise to the claim, for the period permitted by applicable law.
Nothing in these Terms excludes rights that cannot be limited or waived under consumer-protection law applicable to the user.
Indemnification
You agree to indemnify, defend, and hold harmless Vistus and its representatives, personnel, suppliers, and partners from claims, losses, damages, expenses, charges, penalties, and fees arising from misuse, breach of these Terms, submitted content, infringement of third-party rights, fraud, improper chargebacks, or noncompliance with applicable law.
Changes to these Terms
Vistus may update these Terms to reflect changes in the product, law, security, operations, or business model. The current version will be published on this page with its effective date.
Continued use after changes indicates acceptance of the updated version. If you do not agree, stop using the platform and, where applicable, request account closure through the available channels.
Governing law and venue
These Terms are governed by the law applicable to the platform operator, without limiting consumer-protection or data-protection rules applicable to users in their jurisdiction.
The courts at the operator's domicile are selected to resolve disputes arising from these Terms. Where the user is a consumer, the right to bring a claim in the courts of the user's own domicile is preserved as required by applicable law.
